1. Acceptance of Terms

Welcome to PicWash (the "Service"), operated by PicWash Team ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website picwas.web.id and all related services, tools, and features (collectively, the "Service").

By accessing or using PicWash, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Service.

2. Description of Service

PicWash provides online image editing and processing tools, including but not limited to:

  • Image compression and optimization
  • Image resizing and cropping
  • Background removal
  • Format conversion (JPG, PNG, WEBP, etc.)
  • Watermarking and other image enhancements
  • Other image editing tools as may be added from time to time

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Eligibility

To use PicWash, you must:

  • Be at least 13 years of age (or the minimum age of digital consent in your country)
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the Service under applicable law
  • Use the Service in accordance with these Terms and applicable laws

4. User Accounts

While many features of PicWash can be used without an account, certain features may require registration:

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate and complete registration information.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree NOT to:

  • Upload or process images that are illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Upload images that infringe upon any third-party rights, including intellectual property rights
  • Use the Service to distribute malware, viruses, or any harmful code
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service for any commercial purpose without our explicit permission
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated systems (bots, scrapers, etc.) to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service to process images of minors without appropriate consent

6. User Content

Regarding images and content you upload:

  • Ownership: You retain all ownership rights to your uploaded images.
  • License: By uploading images, you grant us a limited license to process, store, and display those images solely for the purpose of providing the Service.
  • Responsibility: You are solely responsible for your images and ensuring you have the right to upload and process them.
  • Storage: Images are temporarily stored for processing and automatically deleted within 24 hours (see Privacy Policy).
  • Review: We reserve the right to review and remove any content that violates these Terms.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by PicWash and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

  • The PicWash name, logo, and all related branding are trademarks of PicWash.
  • You may not use our trademarks without prior written permission.
  • The underlying technology and code of the Service are proprietary.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS
  • UNINTERRUPTED OR ERROR-FREE SERVICE

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • PICWASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US (IF ANY) IN THE PAST 12 MONTHS.
  • WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA, IMAGES, OR PROFITS.
  • WE ARE NOT LIABLE FOR THE ACTIONS OF THIRD PARTIES OR EVENTS BEYOND OUR CONTROL.

10. Indemnification

You agree to indemnify, defend, and hold harmless PicWash and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, expenses, or costs (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your uploaded content

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

12. Modifications to Service and Terms

Service Modifications: We reserve the right to modify or discontinue the Service (or any part thereof) at any time without notice.

Terms Modifications: We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Jakarta, Indonesia.

14. Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes through good faith negotiations. If we cannot resolve a dispute within 30 days, either party may pursue legal action.

For small claims court matters, either party may elect to have the dispute resolved in small claims court rather than through negotiation or formal litigation.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to reflect the original intent as closely as possible, and the remaining provisions shall remain in full force and effect.

16. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. A waiver of any breach will not be deemed a waiver of any subsequent breach.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PicWash regarding the Service and supersede any prior agreements.
